The Federalist, XLVII
The author intends to investigate THE STRUCTURE AND DISTRIBUTION OF POWERS OF THE FEDERAL GOVERNMENT.
The OPPONENTS OF THE CONSTITUTION reject the alleged abuse of the principle of policy: THE EXECUTIVE, LEGISLATIVE AND JUDICIAL ARE ARRANGED IN SUCH A WAY THAT EVERY BALANCE IS RUINED AND THERE IS A RISK THAT CERTAIN AREAS WILL BE DESTROYED BY THE EXAGERATED POWER OF OTHERS. In the structure of the federal government this measure is ignored, by which the legislature, the executive and the judiciary have to be distinct and different. However, the author maintains that the hoarding of power would be a tyranny and THE CONSTITUTION IS NOT THE CAUSE OF THIS ACCUMULATION OF POWER. Although in many cases the essential principle of the separation of powers was abused, it was thanks to an exaggerated combination of power of the different agencies and no measures were taken to avoid this situation.

However, the author resorts to MONTESQUIEU, who used the BRITISH CONSTITUTION AS A MEASURE: POWERS ARE NOT RADICALLY DIVIDED, NOR ALL POWER RESTS IN A SINGLE ORGANISM. The executive is part of the legislative authority, it has the privilege of consummating agreements with foreign monarchs and the members of the judiciary are appointed and dismissed by it with the authorization of Parliament. But he cannot dictate laws autonomously, nor apply justice on his own. Likewise, the legislative power is the recipient of the accusations of high officials, by the Judicial Power. He cannot exercise any judicial function, but he can remove the judges from their positions through a sentence of their two chambers. The members of the judiciary participate, without vote, in legislative discussions, but cannot exercise legislative or executive functions.
NO MEASURES WERE TAKEN TO MAINTAIN A REAL DIVISION. WHILE THERE CANNOT BE FREEDOM IF THE POWERS RESPOND TO A SINGLE PERSON, THERE IS NO CONSTITUTION IN WHICH THESE ARE TOTALLY INDEPENDENT OF EACH OTHER, WHAT EXISTS IS AN INTERRELATION
LIKEWISE, THE AUTHOR APPEALS TO OTHER CONSTITUTIONS TO DEMONSTRATE THAT THE POWERS SHOULD BE SEPARATE AND THAT THERE IS AN INTERRELATION BETWEEN THEM. In this way, in the New Hampshire Constitution, the Senate is a court whose function is to try accused officials, the President is part of the Senate and presides over it; and he is elected annually by the legislature.
