I have blood relative spanning one hundred years and in their best interest I believe my life experiences should be shared with the world. It is my belief that GOD does not wish the following issues to fade quietly into the night but to be brought brightly into the light.

What concerns me is not the way things are, but the way people think things are. I filed discrimination claims with Equal Employment Opportunity Commission (EEOC) against the military defense contractor and EEOC as well as the Office of Federal Contracts Compliance (OFCC) claims against one of this nations leading higher education catholic universities and received (not unexpected) unfavorable federal court proceeding results from both agencies.

My concerns are in the area of fair and equal (or the lack thereof) practice in employment opportunities for male Americans of African descent. I worked for two of the largest employers in area one a military defense contractor and the other higher education catholic university.

Both employers release me during economical hard times (as lifes history has it Blacks were the last hired and the first fired) the first after (16) years of excellent services in 1993 for alleged reduction in workforce and the other after (10) years of excellent services for alleged performance issues in 2005.

Where as in the case of EEOC the director and its leading attorney were both American of African decent, however in general the perceived notion is that both individuals would view this from an objective view point as an opportunity to potentially help correct past employment practices by employers that utilize government funds and discretely discriminate against various protected class minority employees.

This activity continually go untested and while the disservices I experienced only perpetuate status quo practices of the past, by both EEOC and the Employers.

EEOC performed as I had anticipated (with defense contractor) the findings resulted in there was reasonable cause to believe I had been discriminated against, however the agencies leading attorney when it came to negotiating a fair and reasonable settlement amount favored with the employer and refuse to negotiate. He recommended I pursue outside legal counsel I was provided a letter of the right to sue the employer. I didnt have a chance in hell of over coming big business and the relationship private attorneys have with big business. A couple private attorney firms only conceded to the same standards as EEOC and lacked the will to negotiate.

Where are the adjudicators for the people that will judge rightly in every matter brought before them? Due to a lack of financial resources and the ability to appeal the summary judgment after five years of legal proceedings the case was ultimately dismissed.

Employers continually go untested and the disservices to protected class employees serves notice that nothing will become of filing a complaint against your employer.

Little did I know the learning experiences throughout this process would come in handy some ten years later.

The case of OFCC the director and its leading investigator were both white women minorities, the perceived notion is that both individuals would view this from an objective view point as an opportunity to potentially help correct discriminating employment practices by employers that discretely discriminate against the various protected class minority employees.

I repeat again where are the adjudicators for the people that will judge rightly in every matter brought before them?

OFCC leading investigator did exceptionally well, however due to circumstance beyond the investigators control the ultimate finding were politically manipulated in favor of the university.

The action by the director allows the employers continually go untested and was a disservice to protected class employees.

    SUCCESS COMES FROM WITHIN YOU

    "While God can bless you with certain things in life, your success comes from something much greater. It comes from the presence of God that is with you and in you. When you know who you are and who is with you. You know that when God is with you, you are a success.

    True success is to know and fulfill the will of God for your life. But success according to the kingdom of God is based on God’s presence, and His Spirit leading and guiding us every step of the way. The key is to stop pursuing things and start pursuing God.

    You see, for too long we have been looking to everything outside of ourselves to define our success, but God is trying to get us to see that His presence with us brings us all the favor and success we will ever need. With Jesus living in you, there is no possible way you can fail. In fact, you win all the time because God is with you.

    In order to get a new vision of success, you must make a decision to meditate in the Word of God until your thinking begins to change. The only reason many people are not walking in the success and good life that God desires for them is because they don’t see themselves as God sees them. But when you understand who you are, and who is with you, your life will begin to change.

    God is constantly perfecting those things that concern you and ensuring that you do not fail or miss the meaning and scope of your life, which is God and God alone. You are prosperous in your spirit, soul, and body because of what Jesus has done and because He is with you, in you, and living through you. Cast off a defeated mentality and embrace the success that only comes through knowing God."

    For everyone born of God overcomes the world. This is the victory that has overcome the world, even our faith. Who is it that overcomes the world? Only he who believes that Jesus is the Son of God.

    BLACK AND BORN TO SUCCEED

    (DISCREET DISCRIMINATION)

    21th Century Professional Male American of African descent born in the fifties; and resided in segregated housing from birth to early teen years, attended integrated K-12 in a Model City Public Educational System with the Racial Composition of 50/50 Black/White with an insignificant number of Hispanics. I served in the United State Air Force during the Vietnam Era as a Jet Engine Mechanic on the B52 Bomber.

    CHAIN OF EVENTS

    During 2001 War Declared on America—from that moment on the following major life changing events took place in my life.

    1) After (6) years of acceptable services with a Higher Education Catholic University I received the first bad performance evaluation by an employer in my life.

    2) Approximately one year later the employer rescinded the bad performance evaluation.

    3) Over the next three years my eldest daughter recently divorced and a single parent of (3) three children spent (2) tours of duties in Afghanistan and/or Iraq while serving in the active duty in the U.S. Army.

    4) During the end of the fourth year my Eldest Daughter was about to redeploy to Afghanistan and/or Iraq unknown at the time I begin to relive a past war experiences of serving in the Indo-China War.

    Over the next three years my youngest daughter’s husband and soon to be father of (1) child spent (2) tours of duties in Afghanistan & Iraq. At the time of husband 2nd redeployment my Daughter was due to have a child and I had to travel to Seattle, WA to bring her home so she would not conceive my grandchild alone.

    5) Three to four years later I begin suffering from regular abdominal pains of which I had never suffered before and my family physician places me on prescribed medication.

    6) Approximately one year later I was officially terminated from employment with the University due to what I perceived to be discreet employment discrimination. This issue as far as the University was concerned was resolved by summary judgment in court.

    7) In 2006 I became divorce from a marriage of 17 years whereas divorce court proceedings began during the fourth year and became final by the end of the fifth year preceding the wars.

    8) Around the fourth year after the war began my wife suffered an on her job head Injury resulting in a workers compensation claim with her employer that I help to resolve and to the best of my knowledge was resolved in her favor years later.

    9) During the fourth year after the war began my youngest married son father of (5) children; commenced legal proceeding due to domestic violence & battery charges is confronted with (2) Felonies; my son was exonerated of all charges shortly after my employment termination.

    10) During the third year after the war began I received my second bad performance evaluation by an employer; I was then placed on a performance action plan while at the time the employer was well aware my stressed out mental state of mind and instead of offering a fellow American and valued employee a hand up; after 10 years of honorable services I was discharged for alleged poor work performance. I will go to my grave believing that the University failed to provide reasonable accommodations for me a (55) year old African American professional man with a (30%) military service connected disability.

    11) During the final years of my employment with the University for a period of about six months I attended weekly stress recovery therapy sessions and my family physician placed me on prescribed medication.

    12) For a period of around six weeks I was on emergency Family Medical Leave Absences leave while on family physician prescribed medication.

    13) Shortly after a loss of employment and due to loss of insurance I no longer could afford medical treatment it became a matter of self-defense and for the common good and safety of others I intentionally failed to appear for Defensive Driving Course and allowed my driver’s licenses for the first time ever to be suspended. I later enrolled in the VA rehabilitation facility and diagnosed with depression and placed on new prescribed medication. After several years driver licenses were reinstated without incident.

    14) One year after losing my employment and unsuccessful job searches I begin working as a community volunteer for a local 501 c 3 community development organizations.

    15) A little more then one year after release from employment I spent years in self—initiated medical recovery by performing 50-75 hours per week as a community volunteer for 501 c 3’s, family home care provider and other services for the Church of Christ.

    16) Eight years after the declaration of war I was required to perform physical therapy due to injury of unprovoked accidental domestic dogs attack causing a fracture right wrist and bone eventually healed.

    17) Three to four years after the war began my elderly parent’s health begin to take a bad turn. Mother 90 years of age is diabetic and lost her sight after going through several eye operations, as well as, experiencing agonizing weekly inconsistent low level sugar episodes this issue was resolved after a change in effective medical treatment. Father age 100 was experiencing kidney problems and underwent an operation, he underwent a second operation. My father passed at the age of 103 on April 1, 2012.

    Both parents were living in their own home while also caring for a 60-year-old special needs disabled nephew. Both parents and nephew require around the clock daily health care and observations. I had night shift duties 10PM through 8AM (7) days per week. I attend my first out patient stress therapy session scheduled for August 2009 Veteran Administration Health Care Facility. Stress therapy sessions ended in November 2010 after my visit to make trip to Holy Land of Israel. In May 2011 I went on a three month sabbatical to write book so that I might move on with my life.     PREFACE—WORK EXPERIENCE

    Chain of events that lead to the straw that broke the camels back…

    I held the position of High School class president of the Industrial Cooperative Training Course (ICTC). Having held the position I took notice of how local employer would take full advantage of the opportunities ICT provided.

    I was an employed high school student apprentices Machinist Tool & Die Maker. I left this job to serve in the U.S. Air Force in March 1970. I returned home and resumed employment in 1973 and was offer foreman position as a Tool and Die Machinist of which I declined because I was not looking for permanent employment I was only satisfying my mothers insistent of my doing something constructive.

    I left employment to enter the college of business in pursuit of an accounting degree from a local community business college funded by the GI Education Bill. While carrying a B+ grade average during the initial grading period I was advised due to attendance that I would receive a failing grade by the dean of students however I informed him that I was a disabled veteran and had excused absences my conversation fell on death ears and I sought counsel with the business school president and a member of the school board of directors but was advised that the dean had final say and I was at his mercy.

    I end up receiving failing grades for the period for those courses however was more determine then ever to complete what I had started, so I did. I made the
