    PREFACE

    For nearly thirty years I’ve represented buyers, sellers, brokers and trainers in transactions and disputes involving equine sales. Despite the amazingly swift reporting that occurs on the internet through social media, blogs and forums, as well as buyer/seller specific sites, disputes continue to be on the rise and the same old sins are being committed - often by the same sinners. Even in light of the readily available buying and selling tips information on-line, the same mistakes are repeated. Our sport and performance horses are expensive to acquire and maintain making stakes high when something goes wrong shortly after a sale. Those states with an active equine industry, particularly a racing industry, have been aggressive in enacting laws to regulate sales, commissions and to control deceptive practices. Yet again, the same buying and selling mistakes and misconduct continue despite equine sale and general sales of goods laws, and with or without the assistance of professionals, including lawyers.

    To the more seasoned buyers and sellers, the issues addressed in this book may appear simplistic and matters of common knowledge. Everyone knows that you protest; yet when emotions take control while eyeing that beautiful, shiny horse, frequently logic and reason fly out the window. Let me assure you the number of disputes brought to the attention of lawyers, whether or not those disputes result in active litigation or in a breed or sport horse association complaint, continue to involve the exact same problems - problems which could and should have been avoided. Even as this book is being written the sport horse community is abuzz about lawsuits involving allegations of the misapplication of hundreds of thousands of dollars (and Euros) of sales proceeds from a
