1.1 Introduction

If you have purchased this book, this means you have every intention to take the examination that you may be qualified to be a Notary Public within the state of New York. There is the chance that you would want to know what are the requirements needed for you or for another person to be a notary public in New York? The concept of notaries public, as they are wont to be called in the plural, is defined by the New York State Department of State, as those individuals who have been commissioned by the Secretary of State.

First, there must be a distinction drawn with regards to notaries public. There might be some confusion that arises as to whether attorneys-at-law can be notaries public, or is the notary public considered to be an attorney? The New York Department of State outlines first the functions of a notary public wherein they are permitted to perform certain functions. These include:

The administration of oaths and affirmations

The taking down of affidavits and depositions

The receipt and certification of acknowledgements and proof of written instruments such as deeds of sale or land transfer, mortgages and the powers of attorney.

The issuance of demands, but in accordance with the provisions of Notary Public Law, these demands are only issued for the acceptance and payment of foreign and inland bills of exchange, the issuance of promissory notes and obligations in writing which are considered part of negotiable instruments. It must be noted that in this latter circumstance, the notaries public are permitted to protest the non-payment of these demands when presented, and these are done free of charge.

Due to the nature of their functions, employments for notaries public are centered on institutions that encounter a high volume of paperwork that requires the presence of a person who is able to address these depositions, deeds, various written legal instruments and other similar documentations that are involved in the operations of these institutions. As such, banks, law firms that encounter a high volume of financial and real estate transactions are most likely to require the need for a notary public in their offices. As a prospective notary public, it is expected that you are to familiarize yourself with these functions.

Back to the question posed in the previous paragraph. Not all notaries public are attorneys-at-law by profession, and likewise, not all attorneys-at-law are notaries public. However, there are special dispensations for attorneys-at-law, as they are allowed to be notaries public without the need for further examination. It is important to note that the commission of a notary public only lasts for four years.
