I remember hearing the quote, A life worth living is a life worth recording.
The originator of that quote is a man by the name of Jim Rohn. When I first heard those words, something inside me ignited. I believed in myself, and I knew my life had purpose and value and that I should share my life experiences with the world. Unfortunately, that was as far as I got—a thought. I was probably in my early twenties when I first captured those words. Now that I have a few years under my belt, I view life through a different set of lenses. I guess my assignment has changed. My passion now is to educate and empower a citizenry through the storytelling of my life experiences. Through our life experiences, we should walk away with learnings to share with others. This story surrounds the NFL Concussion Settlement, the race norming, and the greed associated with it.
I share this story because no one has shared the NFL Litigation Settlement issue from a layman’s perspective. My experience is in the area of finance. I joined the investment arm of a company established by the same attorney who was litigating the NFL claims. Both the attorney and the securities professional have fiduciary responsibilities to their clients. With licenses and experience, one normally would not question the integrity of an attorney or a licensed securities professional; therefore, you proceed, trusting the individuals are seeking the clients’ best interest. It never occurred to me individuals may have hidden agendas.
My hope is that I enlighten individuals who are going through this NFL litigation process about some of the internal processes they may not know about. I also want to bring attention to how the retired NFL claimants are being treated with the hope of bringing correction to a disgraceful process. The retired NFL claimants are the ultimate victims. And lastly, give hope to everyone who reads this book that you were designed and equipped by the Creator to handle anything life throws at you. You are a leader. You were born a leader. Now comes the process of discovering the leader within you. When you are in adverse situations, it is then when your mind is at its sharpest.
The Beginning
It was a December afternoon. Major changes were taking place within Bond Financial (Bond). The company sold a division (under which I was housed) to another company that was focused more on life insurance sales than securities. The thought of going independent seemed to be the best alternative for my future. While pondering my thoughts and planning my goals and objectives for the new year, which was fast approaching, my phone rang. It was the husband of one of my clients (Derek Baxter). I hadn’t spoken with Derek in years. Derek contacted my office several years ago seeking help with a life insurance policy his mother had. Derek’s mom was employed with the State of Texas, where Bond provided the group life insurance plan. His mother had passed, and he was seeking some assistance regarding the execution of the policy. Upon assisting him, Derek introduced me to his wife, who was employed with the State of Florida. She became my client. After exchanging salutations and catching up on what each of us had been doing over the last couple of years, Derek explained to me the reason for his call. He had a potential client for me. The referral was an individual he was working for, seeking liability insurance for his law firm. I told Derek I didn’t handle liability insurance; however, from that conversation, I was encouraged to meet with his employer, Dr. Tom Henderson. Dr. Henderson is a civil attorney in the Miami, Florida, area, where he has a law practice, Henderson & Associates, PA. Dr. Henderson was part of a team of lawyers who won the Florida tobacco lawsuit claim in the 1990s that led to a $20 billion settlement with the State of Florida and a national settlement of $250 billion. In addition to his law practice, Dr. Henderson established a university, Phoenix Graduate University International (PGUI), as well as an investment firm, Phoenix Capital Group, LLC (PCG). Derek felt there might have been some opportunities for me within the Henderson operations. He stated he would speak with Dr. Henderson about me and see if he could schedule a time for the two of us to meet, and he would get back to me. I received a call the following day. The meeting was scheduled for Wednesday afternoon.
I went to the law firm to meet Dr. Henderson. Outside the building, I noticed the kiosk displayed the law firm and the university. However, the investment company was not displayed outside the building. I entered the building, and there was a receptionist at the entrance. I informed the receptionist I had an appointment with Dr. Henderson. The receptionist called Dr. Henderson’s office, and someone from Dr. Henderson’s office (Brianna Mitchell) came down the hall to get me and escorted me down the hallway to the law firm’s waiting area. Mrs. Mitchell was very polite. She introduced herself and asked me if I wanted anything to drink while I waited for Dr. Henderson, to which I said, No, thank you.
She told me Dr. Henderson would be with me shortly and to have a seat in the waiting area, and she went into her office. Dr. Henderson came out of his office, introduced himself, and invited me into his office. Upon entering his office, we sat down. I opened the conversation by sharing with Dr. Henderson some of the things Derek Baxter told me about him. I handed him my resume and began telling him a little about me and my background. After I finished, Dr. Henderson began telling me a little about himself and his operations. He proceeded to take me on a tour of his operations. His operations housed three-fourths of the first floor. The building itself is rectangular in shape, primarily divided into four quadrants with a hallway running down the center of the length of the building. The front right side of the building (described from the main entrance of the building) housed Henderson & Associates, PA. The front left housed Phoenix Graduate University International, Phoenix Capital Group, LLC, and Phoenix Sports and Entertainment, LLC. The back right side of the building housed the preliminary testing for retired NFL claimants as well as their scheduling operations (where flights, hotels, Ubers, and doctors’ visits were coordinated). While touring the preliminary testing operations, I was surprised to see Dr. Earl Washington as a part of the NFL testing. Dr. Washington was, at one time, my primary care physician as well as my class leader in the church I previously attended (but I’m still on the roll). He was in between appointments, so I was able to say hello to him. It was nice to see a familiar face. The back left side of the building was leased by another organization (an insurance company) not associated with Dr. Henderson’s operations. The person who was overseeing the investment operations of Phoenix Capital Group (PCG), Darryl Reed, was not in the building at the time of my appointment; however, Dr. Henderson gave an overview of PCG’s operations and wanted me to meet with Darryl Reed to obtain more details. We returned to Dr. Henderson’s office to wrap up the meeting. That evening was the company Christmas party at the Hotel Louvre, located in the heart of downtown Miami. I was extended an invitation to join them by Dr. Henderson. Individuals working in other areas of the State would be attending, and I would get a chance to meet them. I accepted the invitation but told Dr. Henderson I was scheduled to usher that evening for my church’s Wednesday evening worship service, but I would join them after the service was over. While we were wrapping up the appointment, a gentleman entered Dr. Henderson’s office. We were introduced. His name was Anthony Williams. Dr. Henderson was telling Mr. Williams about me and my background. I found it interesting that Dr. Henderson made the statement, Her eyes are clean.
I didn’t know what that meant. Her eyes are clean. I had heard the eyes are the window to your soul, but I didn’t know what he meant by that statement. I didn’t think much of that statement other than I had never heard someone describe me as having clean eyes. I considered it a compliment. I thanked Dr. Henderson for his time and that I looked forward to meeting and talking with Darryl Reed as well as others within his organization at the Christmas party, and I returned to my office.
The
Christmas Party
The Christmas party was on the top floor of the Hotel Louvre in one of the hotel banquet halls. Upon entering the room, I saw most of the people were on the dance floor. I was looking for a familiar face: Dr. Henderson, his administrative assistant, Brianna Mitchell, Dr. Washington, or Anthony Williams. I saw Dr. Henderson on the dance floor. I proceeded to walk to the back of the room, where the food, drinks, and tables were set up, to find a place to sit. I came to a table where the table setting was not disturbed. It appeared to be available for sitting. I saw an older lady standing by the table. I asked her if the seat I was standing in front of was available. She directed me to a seat that was available and began to introduce herself as Dr. Henderson’s wife (Janet Henderson). She was very cordial. She asked me if I wanted something to drink. I said, A glass of merlot would be nice.
She brought me a glass, and I thanked her for her hospitality. She began talking about the presidential election. She was upset over the recent presidential election results. The Republicans won the Whitehouse, and she is a Democrat. I told her God is still on the throne, and He takes care of His own. Nothing happens unless He allows it. At that time, Dr. Washington entered the banquet hall, and I beckoned him to come and sit by me. I was asking Dr. Washington who various people dancing on the dance floor were. I noticed a man and woman on the dance floor dancing very lewdly. I asked Dr. Washington who they were. He told me that they were Darryl Reed and his girlfriend (Kathy Baker). I believe Mr. Reed knew who I was. I’m pretty sure Dr. Henderson had mentioned me to him. Reed walked past me and stared at me with a condescending look. I reciprocated the gesture. He never introduced himself. I thought that was strange. This guy didn’t know me. What was that all about? I left the table to get something to eat. There were a lot of people at the Christmas party. Dr. Henderson eventually exited the dance floor and came over to make me feel welcomed. He introduced me to his family, his wife and three sons. I informed him I had met his wife earlier and that she was very hospitable. I stated she had some issues regarding the presidential election and that I was trying to reassure her everything was going to be all right. Dr. Henderson agreed she’d been upset since the results. No more was really said about the presidential election. Later that evening, I participated in the Soul Train Line. It was a nice Christmas party. I observed a blend of nationalities, but I wasn’t introduced to anyone outside of the Henderson family. Before I left, I thanked Dr. Henderson for the invitation and complimented him on having a wonderful Christmas party. He stated he would have Mr. Reed follow up with me regarding Phoenix Capital Group. I thanked him once again, said goodbye to Dr. Washington, and left to go home.
Meeting with Darryl
I received a call from Darryl Reed the next day. Mr. Reed informed me he received my resume from Dr. Henderson and was calling to follow up with me regarding Phoenix Capital Group and its operation. He emailed me some information regarding Phoenix to review, and we scheduled a date and time to meet. When I met with Mr. Reed, we both
