    The additional information I have collected searching the internet is a magical tool, uncovering the Indian Government Land Scams. As everybody knows, Google indexes billions of web pages which allowed me to search for the information I desired through the use of keywords. There are some other search engines as well, but Google is the dominant search engine in the United States market.

    I’ve also used fifteen other search engines, including; Bing, Yandex, CC Search, Swisscows, DuckDuckGo, StartPage, SearchEncrypt, Giburu, OneSearch, Boardreader, Givewater, Ekoru, Ecosia, SlideShare and InternetArchive. But I realized no one serves better search results than Google.

    Introduction

    In the HUDCO Place Andrews Ganj Land Scam book, Alborz covers HUDCO concealing various facts regarding the title and unauthorized buildings constructed in the garb of the Government umbrella without proper land use. The boom in the hotel industry and the appreciation for land in India where every property dealer became a builder fly-by-night fraud operator brought these fraudsters to light.

    HUDCO, a President of an India-owned company, more particularly in the National Capital Territory of Delhi lured investors to sell Hotel properties by concealing its title, not disclosing unauthorized constructions and various other material factors, of which one of them were no electrical connections, and other facilities boasted in the brochure.

    HUDCO was charging investment interest @17% pa to the Government on the buildings constructed with no statutory approvals. Finally, they chalked out a plan with the ministry and met the funding by selling these unauthorized properties, defrauding the bidder. The advertisements issued deliberately concealed information necessary to be disclosed in the brochure.

    Bidding on the properties were presented by HUDCO on behalf of the Government to potential investors, under which MS Shoes was defrauded. MS Shoes East Limited, Pavan Sachdeva, and his 51,000 shareholders covering India still suffer due to the deceit practiced by HUDCO.

    Brochures circulated and pre-bid meetings advertised by HUDCO as being a government-owned company, and the lessor being the Government of India showed no valid reason to research the Government’s Credibility. Therefore, MS Shoes East Limited sought with good intentions to invest in a solid business adventure. However, they were quick to circumvent any negative opinion about Andrews Ganj Land projects offered by HUDCO, taking the Ministry of Urban Development name in the brochure.

    As part of the investment deal, HUDCO agreed to provide MS Shoes East Limited a Five-Star Hotel land building to be constructed on sanction of building Hotel. However, HUDCO, without sanction of a revised layout plan, unauthorized built car park basement, 363 rooms, 9 restaurants, 25 shops already constructed by HUDCO; illegally concealing the use and unauthorized constructions being material facts cheated the prospective investor. In this fraud, the Ministry of Urban Development, which per law could be termed as a conspirator. Therefore, leaving naïve MS Shoes East Limited seeking justice for fraud victims in a long-drawn and uncertain process.

    The complex nature of disputes has taken nearly a quarter of a century to get justice from the courts, per the litigation policy of the Government. Congress Government directed HUDCO to recover their investment in constructions at Andrews Ganj Land by selling properties, as they could no longer handle the burden of 17% interest being charged by HUDCO on the investments made in the unauthorized constructions at Andrews Ganj, a prime piece of land in the heart of Delhi.

    Chapter: One

    Public Money Being Wasted

    Presently, India is changing and significant controls have been brought, but the seeds the Congress Government has sowed and the plants in the way of corruption have grown in the roots cannot be pulled, cut, or burned. The power of the officers in deciding has been curtailed by the Modi Government, but then the officers are not putting up files that have ample cause even. Much is achieved by Modi Ji, but much is not achieved even after the brief span under him, as 8 years is nothing to take out the solid roots' Congress Government has built-in.

    The Congress Government has done whatever wrong can still be corrected, but at an unhurried pace, as further progress is also required to be done by the present government. Now ethical laws framed for farmers to stop corruption are being fought by the opposition. Why? Simply because opposite parties have to oppose. It is like in a court case, the opposite parties must oppose an excellent case, whether good or bad as if the lawyer is doing his duty. But then that is the system.

    Especially in India, there are many corrections or scams which are being missed by the Modi government. The same is with MS Shoes refund of amounts paid. Then officers have one excuse: it is pending in court and let the court decide. But when will the court decide when the person dies? But then these officers do not want to give their consent to court, and if they do, then an important issue is framed.

    Modi Government schemes and legislations approved may not bring in immediate benefits, but in the long run, the results achieved would be greater than observed at present. Anything introduced takes time to get the results. Major schemes introduced by the Modi Government in 2014, which will bring benefits and results for several years to come. There have been over 26 important schemes launched by the Narendra Modi government.

    The Modi Government has launched many new schemes for the development of the country and the residents, and the results can be observed after twenty years. They are:

    Atmanirbhar Bharat Abhiyan, PM-KISAN (Pradhan Mantri Kisan Samman Nidhi) Scheme, Pradhan, Mantri Kisan Maan Dhan Yojana, PM Garib Kalyan Yojana (PMGKY), Pradhan Mantri Shram Yogi Maan-Dhan, New Jal Shakti Ministry, Jan Dhan Yojana, Skill India Mission, Make in India, Swachh Bharat Mission, Sansad Adarsh Gram Yojana, Sukanya Samriddhi Scheme–Beti Bachao Beti Padhao, HRIDAY Scheme, PM Mudra Yojna, Ujala Yojna, Atal Pension Yojana, Prime Minister Jeevan Jyoti Bima Yojana, Pradhan Mantri Suraksha Bima Yojana, AMRUT Plan, Digital India Mission, Gold Monetization Scheme, UDAY, Start-up India, Setu Bhartam Yojana, Stand Up India, Prime Minister Ujjwala Plan, National Mission for Clean Ganga (NMCG), Atal Bhujal Yojana (ABY), Prime Minister’s Citizen Assistance and Relief in Emergency (PM CARES), Aarogya Setu, Ayushman Bharat, UMANG–Unified Mobile Application for New-age Governance, PRASAD Scheme–Pilgrimage Rejuvenation And Spirituality Augmentation Drive, Saansad Adarsh Gram Yojana (SAGY), Shramev Jayate Yojana, Smart Cities Mission.

    All the above and many other important legislation will bring magnificent results for the next twenty years. It is the same way like Rajiv Gandhi did something, and all criticized him and believed he is running the country for computerization of his offices. After Prime Minister Rajiv Gandhi rose to power in 1984, the computer became the emblem of his ambitious plan to modernize this backward, poverty-stricken country. The youthful leader and computer buff issued a clarion call to lift India into the 21st century with the help of Western technology.

    Similarly, Rajiv Gandhi’s vision to bring the era of technology by introducing computers in India will always be remembered as a remarkable contribution to the development of the nation. India might have officially started the journey of becoming a digital-empowered nation in 2014 onward after the Modi Government, as the Modi Government further pushed it, but in all actuality, Rajiv Gandhi was the real architect of ‘Digital India’.

    Rajiv Gandhi believed, India is not a stagnant country. We are progressing. We are in a state of flux. Our society, our economy, is developing. Science and technology must be the key to this development. India is an old country but a young nation…. I am young and I too have a dream, I dream of India strong, independent, self-reliant and in the front rank of the nations of the world, in the service of mankind, he would say. During his brief span as India’s Prime Minister, Gandhi could lay the foundation of modern India through certain concrete steps. Today there is a tremendous awareness. Three years ago, you had to educate a customer in India about what a computer is and what it can do. Now even a layperson can tell the difference between hardware and software.’’

    Rajiv Gandhi was the reason behind the PCO (public call office) revolution. PCO booths helped connect even the rural areas to the world outside. Due to his efforts, MTNL (Mahanagar Telephone Nigam Limited) was established, which helped in the spread of telephone networks in 1984.

    Indeed, the initial flush that followed Mr. Gandhi’s call to modernize is giving way to a more realistic view of the computer’s potential. Many Indians scoff at the government’s pledge to put a computer in every village.

    But there are many mistakes and frauds, as well as scams by the Congress government, which have not come to the light of the Modi government. These could be ratified or admitted continuing, or could be undone, but who will do it? Rs. 5000 crores (US Dollars 1593.87 million) scam has escaped the Modi government because the officers keep hiding files seditiously, but it is nonjudicial, how? The infrastructure projects in Delhi, and most prime ones, cannot be neglected by the central government, as it does not fall under the Delhi Government, and one day or the other it may come to the limelight.

    Studying this scam of Andrews Ganj Land, I could not understand how government remains rich by holding the monies paid by MS Shoes Received by fraud by concealing material facts and let Rs. 5000 crores (US Dollars 1593.87 million) land remain unutilized for the last 25 years. It is distinguished from papers that MS Shoes is willing to give away its right to the properties if the amounts received are refunded with a contractual rate of interest. Any prudent person would consider it to be reasonable, and for any technical reasons, the litigation should not have been prolonged. It seems HUDCO and Government are log-jammed on the wrongdoings by HUDCO without finding out initial wrongdoings by the Congress government.

    Who is the sufferer? The government exchequer and the public money is being wasted. But who will intervene in this scam?

    The amount of Rs. 68.68 Crores (US Dollar 21.89 million) received by HUDCO in 1994-1995 in the garb of allotting part of this precious land on perpetual lease comprising Hotel Land without having any lease in its favor, without land-use of the hotel, unauthorized car park, and without the approval of revised layout plans which were required. In addition, HUDCO also allotted to MS Shoes 363 rooms, 9 restaurants, and 25 shops already constructed illegally, and was unauthorized until September 1999, while the amounts were received by concealing all these facts, which resulted in fraud by HUDCO deceiving MS Shoes.

    All this is detailed in this book, and the next book to reveal the truth behind Andrew's Ganj Land scam.

    Chapter: Two

    HUDCO advertised in Hindustan Times on 26 May 1994 to sell the following properties calling for the bids on 15 July 1994

    Prime Location–Prime Opportunity–South Delhi at Andrewsganj, Housing and Urban Development Corporation (HUDCO) offers a unique opportunity to be part of an integrated urban design complex that covers an 18-acre green zone and added facilities of Park/Jogging Tracks, Swimming Pool, and other water bodies in the vicinity of HUDCO place. The entire complex is a perfect blend of traditional ambiance and up-to-date modern facilities. The offer is for the following properties:

    In addition, proportionate cost of common services, maintenance & taxes will be charged. The last date for submission of an offer is 15 July 1994:

    A brochure containing all the details may be obtained from Mr. H.K. Dubey, Assistant Chief, HUDCO, HUDCO House, Lodhi Road, New Delhi-110003.

    Assistant Chief, HUDCO, Mr. H.K Dubey on 9 June 1994 to Mr. B.R Dhiman (Under Secretary (Land) Ministry of Urban Development:

    You may know HUDCO had advertised for disposal of various properties at Andrewsganj. The last date for submission of the offer is 17 July 1994. Some issues need clarification from the minister:

    What will be formulas for alleviating the ground rent regarding the following proposal?

    Hotel site ground rent will be charged @ 2-1/2 percent of the cost of land (total area of land & coal of land per sq.mt.) as fixed/notified by L&DO or on the cost of land on which the prospective buyer had agreed to purchase the land from HUDCO?

    Cultural Center site: do

    Shopping Arcade Site: do

    Guesthouse Ground rent @ 2-1/2 percent of the proportionate cost of land taken while arriving at the reserve price. If the basin for calculation of ground rent will be other than the one elated above, please be communicated.

    The prospective buyers or the hotel cultural center and shopping arcade desire to know if they may mortgage their respective pieces of land/properties towards their tenders for raising loans for paying part of the cost of land and rising construction. Keeping this requirement of the prospective purchases, a draft sublease document was drafted and sent to the Ministry vide our letter no. HUDCO/AG/GH/Allot/93 dated 30. November 1993 (document marked as IV Sublease for Hotel Site) please confirm your agreement to the above arrangement and convey Government approval to the sublease document sent.

    Government approval to the revised draft lease documents sent vide our letter no. HUDCO/AC/ (Chairman-cum-Managing Director)/HS/94 dated 29 March 1994 may please be expedited.

    An early decision on the above issues is requested since we will have to clarify to the prospective buyers.

    From the above, it can be concluded the Government as part of the concealments by HUDCO, was taking all permissions from the Government and was providing all the information including the land use, lease problem, unauthorized construction, which all was not disclosed in the brochure approved by the Government of India or the Officer of the Ministry of Urban Development.

    HUDCO issued another Advertisement in Hindustan Times on 30 June 1994:

    Prime Location–Prime Opportunity–Offers invited by HUDCO for Commercial Property at Andrews Ganj

    HUDCO has invited offers for a Five-Star Hotel Site, Guest Houses, and Party Room/Restaurant/Kitchen in Guest Houses, Shops in Guest Houses, Shopping Arcade, and Commercial Center Sites at Andrews Ganj. The last date for submission of offers is 15 July 1994. The Prospective Bidders have sought certain clarifications, which are given as under for information of all concerned: -

    The proportionate cost of common services for the Five-Star Hotel site shall be on account of basement car parking only, which would be approximately Rs. 14 crores (US Dollars 4.46 million). Maintenance and taxes would be extra.

    For submission of offers, please note that the last date remains 15 July 1994. Further details may be obtained from Mr. H. K. Dubey, Assistant Chief, HUDCO, HUDCO House, Lodhi Road, New Delhi-110003.

    In pursuance of the advertisements issued by Hudco in the Newspapers calling for the bids of the properties at Community Center, Andrews Ganj, New Delhi, HUDCO issued a brochure to the interested parties which were made available at HUDCO’s office in Delhi. The brochure detailed the information as follows:

    The HUDCO Place, an integrated urban design complex with design control, graphic design, landscape, parking, and other common services, is being developed by Housing and Urban Development Corporation Ltd.
