Chapter 1: The Tax Sale Overages Business - An Overview

What are Tax Sale Overages?

Tax Sale Overages are surplus funds, also known as: overbids, overages, excess proceeds, remainders, etc. They are created when a property is foreclosed on and sold at auction by the County, usually for unpaid Property Taxes, and the property was sold for more than the amount of taxes owed.

This happens more often than you might think, especially since about 2011, due to the uptick in House Flipping, 'newbie' investors at auctions are driving up the sales price to retail value or higher.

The County is not entitled to the Overage, and it rightfully belongs to the property owner (mortgagor). Although the County is required to notify the previous homeowner of the Overage, they mail the notification to the last known address, which is usually that of the foreclosed property. If the previous homeowner has not done an Address Change with the Post Office, or for whatever reason, the Post Office does not forward the mail, the previous owner never gets notified of the Overage, and therefore, is not even aware of its existence.

Tax Sale Overages Availability

First of all, remember that Tax Sale Overages are produced within each County in the USA. There are over 3,000 Counties in the USA. However, while not all States allow for the collection of Tax Sale Overages, approximately 2/3 of them do. This still provides over 2,000 Counties to pursue.

How Does the Tax Sale Overages Business Work?

You begin by choosing a State, along with a County within that State that allows the collection of Tax Sale Overages. Then, you have to locate the web address for the desired County. One way to quickly accomplish this is to visit NACO.org (National Association of Counties Online).

Once you are on that site, click on the (3) bars at the top left of page. Then, click on: Find a County. At that point you'll be brought to a page displaying a map of the United States. Simply click on the desired State, then, click on the desired County. When the County page loads, look to see if the County name is a hyperlink. If it is, it will take you directly to the County website. If it is not, you will need to either search on Google or call the County.

Next, when you arrive on the County website you will have to find and navigate to the page dedicated to the collection of delinquent real estate property taxes, tax sale information or tax sale list. Then, you email the County Clerk and find out who controls the list and how you can acquire a copy of it. More often than not, this is the county treasurer or tax collector. You may need to pick up the phone and call the County.

Sometimes they will offer to mail you the list on a disk saved as an Excel Spreadsheet. They might charge you a small shipping and handling fee. You should always try to get the Tax Sale List for free from the website or via email.

Once you get the list for your 1st County, you put it into a Spreadsheet. You then, sort the list from biggest to smallest Overage Amounts. After that, you must research the State and individual County laws, since every County in every State does things a little differently for Tax Sale Overages. You always need to make sure that you know the rules for each County that you are working.

Then, you go through the list and Skip Trace each the previous owners. Once they are found, you contact each of them and let them know that you have found some Unclaimed Money that belongs to them, and that you are willing to retrieve it for them for a FEE (percentage usually 10% - 50% - your choice).

When they agree to your terms, you send them an Agreement and a Limited Power of Attorney Form, have them sign and date the Forms in front of a Notary Public, and they then, return the Forms to you, along with proof of who they are and proof that they are the previous property owners.

Once you receive the information, you file the claim with the County. Once they review and approve it, they mail you a check for the funds. You turn the check over to the previous homeowner, they cut you a check for your Fee, and you repeat the process, over and over again.

What is Needed?

As I previously stated in the Introduction, a Tax Sale Overages Business is the perfect business to run out of your home. All you really need to get started are the following items:

Home Office with some Miscellaneous Office Supplies

As you progress in your business, there are other things that you will want to acquire to help you build your business, such as: a website, Social Media accounts, Paid Skip Tracing sites, etc. You do not need any of these to get started, but will want to add them to your business as you become successful in order to further your success.

This book will walk you through the process of starting and running this type of business, step-by-step, as well as, how to become an Tax Sale Overages Expert. I will teach you the best ways to go about getting this Unclaimed Money for your clients, along with, exactly how to get paid for your efforts and get paid well.

Now, let’s get started building your business foundation. In the next chapter, you will learn the best way to build the foundation for your Tax Sale Overages Business.

Chapter 2: Getting Started

Before beginning to learn all of the ins and outs of the Tax Sale Overages Business, you must get your business foundation built and ready to support your new business. You are going to need to choose your Business Name and your Business Structure (sole-proprietorship, LLC, etc.). You will also need to: set up a Home Office and your Bookkeeping, create a Business Plan, and get your Business Licenses. You should also eventually setup a website for your business. For your website, you will need to: choose and purchase your Domain Name, choose a Host, choose a Website Theme, and initially set your site up.

This will give you some additional credibility, which will make potential clients trust you more. By the time that you implement all of the strategies in this book, you will have easily earned yourself that title.

After you get familiar with the business and are making some money, you may want to consider hiring a few Employees to do some of the grunt work. These Employees will be titled as: ‘Unclaimed Money Recovery Specialists’, since this is what they will be specializing in. This will also give them some credibility. Once they have reached a certain level of expertise in your company, you can retitle them as ‘Experts’ as well.

Building the Rest of Your House (Business)

After your foundation has been built, you will need to continue to work on your website as you continue to work on your Tax Sale Overages Business. You will need to create: a Logo, a Home Page, additional Pages, Menus, Sidebar Widgets, and a Blog Post. You will also need to learn about: Keywords, Images, and how to best benefit from Google and Bing so that your Posts come up on the first page when certain searches are made.
