Introduction
Social Care and the Law in Scotland was first published in 2000. It was originally intended to support candidates for Scottish Vocational Qualifications to develop their understanding of legislation. Since then it has become a popular core text for people working in all areas of social care and work with children and young people.
In this eleventh edition, we have updated all the legislation and added a new chapter on housing and homelessness following a specific request. We have also significantly amended the childrens’ legislation chapter to provide a separate chapter on child protection. We have tried to encourage and enable more reference to the actual legislation and helpful websites through the use of QR codes (see following).
Increasingly, everyone working in the sector is expected to have a knowledge of the legislative framework within which they operate. This book is intended to act as a reference point for everyone involved in the sector. It is not intended, however, to equip the reader with detailed specific knowledge on either the legal system or on specific legal points.
The law is constantly changing, and we therefore advise you to be aware that, to the best of our knowledge, the contents of this book are correct at the time of writing. Where changes in the law are expected, we have highlighted this.
We would strongly advise you to encourage your manager to ensure that you have access to the relevant texts of the major pieces of legislation relevant to your workplace.

A new feature of this edition is the introduction of QR codes. If you have a ‘bar-code reader’ app on your smart phone or tablet, you can simply scan the square symbol and it will take you to a web-page that we feel is useful for further reading. Please note, these are third party content and we can take no credit or responsibility for the material there. These are all part of the pitfalls of using the internet, but we hope that you still find the feature useful.
