About this ebook

This is my story. In 1985, I immigrated to the United States with the noble pursuit of the American Dream. Through years of dedicated effort, I attained a culmination of achievements, acquiring degrees and expertise in diverse fields such as math, chemistry, pharmacy, healthcare administration, and even contributing to the development of a clinical intervention software in 1998, when the World Wide Web was only 5 years old. Alongside these accomplishments, I built a business in nutritional supplements. However, my story took a disheartening turn as it intersected with a justice system led astray by the manipulations of a bitter and vindictive ex-wife, morally bankrupt attorneys, and a corrupt judge.

Having experienced injustice within the justice system and nowhere else to turn to, I find myself compelled to take my case to the COURT OF PUBLIC OPINION. In doing so, I am committed to sharing my story in this book.

In the American judicial system, the most advanced in the world in my view, the judge has to be impartial to prevent the creation of a crisis of legitimacy. The judge should be acutely aware of the limitation of his/her power. I revere this great nation’s judicial system, but it’s marred with corruption, especially the Family Court system. The Court’s egregious rulings in my case have caused me to lose trust in and respect for the system. Frankly, if you live in this country, you should also be concerned, because what happened to me could happen to anyone.

I feel sad about the current state of the justice system in our country. This is, I believe the greatest moral test and challenge of our time.

While many may believe that the downfall of our democracy - this exceptional experiment, stems solely from the deterioration of our political system, it is crucial here to recognize that the erosion of our justice system also poses a significant and substantial threat. The integrity of our democracy can be equally compromised by the degradation of the very institution designed to safeguard fairness, equality and justice for all.

The court system in our country is more permeable to influence than you think. In my judgement, critiquing the flaws of the system is the highest form of patriotism. And I am glad to have done just that in this book. Our justice system overwhelmingly favored the rich, the affluent and the well-connected. The very notion of equal justice for all in our country is a myth!

    BROKEN JUSTICE - Mamadou Diakite

    Introduction

This is not an easy story for me to tell, but I have to tell it. I have no choice. It’s going to be tough; it’s going to be raw, but it’s going to be fair. I am going to try to be as respectful as I can, but I am not going to compromise the truth. I have to write this story. It’s the right thing to do. I have been put in a position that I would have never in a million years sought to put myself. Although I am a very private person, I have been forced to do this. Sometimes, the intricacies of life throw you a curve ball that requires you to step outside of your elements. This is one of those times.

Having experienced injustice within the justice system and nowhere to turn to, I find myself compelled to take my case to the court of public opinion. In doing so, I am committed to sharing my story. I intend to be wholly truthful, adhering to the principles of honesty and integrity. As a good scientist would do, every claim I make in this book will be substantiated by concrete, factual evidence.

An online version of this book will be accessible through the Broken Justice website, allowing readers to explore the relevant exhibits firsthand. These exhibits, including emails, text messages, motions and more, will be available for scrutiny. For those who purchase the paperback version of this book, these materials can be accessed on the website. Part of the proceeds from the book sales will be channeled into my campaign to restore justice.

I kindly urge you to support my cause by signing the petition. With your help, we can aspire to bring about legislative changes to hopefully improve the legal process, ultimately benefiting the families navigating the complexities of the Family Court system.

Ask any mental health professional: Isn’t it true and universally recognized that when someone is backed into an inescapable corner, the next step in the progression is bound to be catastrophic? Regrettably, this is precisely where I find myself at this moment. The courtroom, a supposed bastion of justice, appears to be an insurmountable challenge for me. I have exhausted all avenues, having attempted every conceivable approach. It has become painfully apparent that the system is riddled with corruption, particularly prejudiced against the poor, those unable to secure legal representation or individuals like me who face racial biases.

Yet, despite these adversities, I refuse to perceive myself as a mere victim. Instead, I am going to actively fight against this injustice. I have been wronged by my ex-wife, betrayed by my own attorney and shockingly, though not entirely surprisingly, let down by the very institution that is meant to uphold fairness and justice, The Court. Let’s face it, our justice system was not built with everyone in mind. Our justice system overwhelmingly favored the rich, the affluent and the well-connected. Therefore, the very notion of equal justice for all in our country appears to be more of a myth than reality.

I feel sad about the current state of the justice system in our country, marred by corruption, cover-ups, racism, bigotry and the pervasive influence of white privilege in the administration of justice. This is, I believe the greatest moral test and challenge of our time.

While many may believe that the downfall of our democracy – this exceptional experiment – stems solely from the deterioration of our political system, it is crucial here to recognize that the erosion of our justice system also poses a significant and substantial threat. The integrity of our democracy can be equally compromised by the degradation of the very institution designed to safeguard fairness, equality, and justice for all.

The declining approval rating of the justice system is indeed a matter of great concern for any democratic society. The judiciary is essential for maintaining the rule of law and ensuring a society that is fair and just. When public confidence in the justice system erodes, it can have extensive implications, not only disrupting the courts, but also jeopardizing the overall stability of our democratic system. This is significant because the court’s survival hinges on its capacity to earn our respect. If we lose faith in judges’ rulings, the court has no power to compel us to abide by its rulings. As founding father Alexander Hamilton well noted in the Federalist Papers, judges have …no influence over either the sword or the purse.

We live in a dangerous time in this country where everything can be explained away, where amorality is celebrated. We live in a world of mendacity and criminality, in which having integrity is revolutionary because everything else seems to be drowned in a sea of deception and dishonesty. We live in a dangerous time where a Supreme Court justice has publicly announced that he has a list of grievances, a list of settled laws he personally disagrees with and wants to overturn. It is astonishing how swiftly ethical rules are discarded when a U.S. Supreme Court Justice proudly and shamelessly proclaims his partisan affiliations. It is important to note here that these unsound reasonings have infected not only the United States Supreme Court, but also courts around the country and this is doing damage to the Court’s standing with the American people. The Court, an institution that relies on public perception for its legitimacy, might be losing the people’s trust. This trust is vital for maintaining the Court’s credibility

Recently, a federal court judge’s ruling was reversed, not once but twice by a very conservative Appeal Court because she wanted to show favor to an ex-president.¹ Even governors are joining the bandwagon appointing unqualified judges to State Courts and State Supreme Courts, …ignoring documented incidents that call into question the judges’ fitness to serve on the State’s most powerful tribunal… as reported in a Florida Bulldog article.² At the same time, the United States Senate confirms unqualified candidates to judgeship who have never tried a case.³

In my specific case, a judge disregarded the law, set aside the facts and the evidence, and ruled on my case based on prejudices he had against me and in favor of personal relationship he had with the opposing party. Ruling on cases irrespective of the law is illegal. It’s 2024, and we are still dealing with the 1960’s issues. Personal relationship cannot and can never be factored into the administration of justice. The title of judge does not make the judge a god, it merely confers on him or her the duty to read the law and consider the facts in the administration of justice. The judge in my case was afforded with a tremendous amount of power, unchecked power in most cases by the State of Florida to protect its citizens, but I am afraid, at least in my case, the judge is using that power for selfish, self-serving interests. Chapter 2 describes in great details my experience in this judge’s courtroom.
