    1. Firstly, it must be understood that there are many different types of testing. However, forensic DNA testing should not be confused with the medical genomic linear sequencing, gene editing or cloning technologies used in the medical field.

    2. In short, the initial methods used to gain admissibility were, in part, a direct analysis of genomic DNA and others utilized (PCR) polymerase chain reaction, such as the D1S80 test; a hybrid method. Manufactured evidence.

    3. Forensic DNA testing was admitted into evidence virtually unchallenged; and the first three appellate decisions in this country, The defendants had no defense experts; Andrew v. State, 533 So. 2d. 841 (Fla app 1988); Coby v. State, 80 Md. App 559A 2d 391 (1989); Spencer v. Commonwealth, 238 VA 275 SE 2d 775 (1989).

    4. As an initial note, lawyers must rely on experts and it is not the expert’s responsibility to train lawyers on their discipline. It is the lawyer’s responsibility for the responsible practice of law to educate themselves on the methods of forensic practices, and to know what acceptable legal methods are employed, and if they are even recognized by the scientific community; what problems have been experienced, and what if any corrective measures have been taken and, Not blindly accept conclusions by experts who have ‘vested interests’ in the technology.
