This book provides a step-by-step guide to the fiancé visa process and explains it in clear, easy-to-understand language.

My name is Bruce, and I have gone through this process successfully and have since shown 1000s of people how to end their long-distance engagement using a K-1 visa. I use a 5 Step process that is detailed in this book:

All the information on the K-1 visa is free online; it is all over the place. So, hunting all that information down while in a long-distance relationship can be very stressful. I have found that understanding the K-1 visa process is very helpful.

What is the K-1 Fiancé Visa?

According to the U.S. Citizenship and Immigration Services (USCIS), The K-1 is a nonimmigrant visa that permits a foreign national fiancé of a U.S. citizen to travel to the United States to marry the petitioning U.S. citizen sponsor within 90 days of admission to the country.

Basic Information and Requirements of the K-1:

Summary of the Entire K-1 Process. The U.S. citizen petitions their foreign fiancé beneficiary with a Form I-129F, Petition for Alien Fiancé and sends it to the USCIS along with the fee (using a credit card, debit card, bank withdrawal, a check or money order) and supporting documents. Here are all the things that need to happen during the K-1 process:

-  Upon receiving the I-129F, supporting documents, and fees, the USCIS conducts a background check on the petitioner.

-  Once approved, the USCIS sends the I-129F packages to the Department of State, National Visa Center (NVC), which sends it to the embassy noted in the I-129F form.

-  The embassy contacts the foreign fiancé and tells them to gather the required documents and has them get a medical exam before an interview with the U.S. embassy consular officer (CO).

-  If the CO approves, the K-1 visa is placed inside the passport of the foreign fiancé, which they can use to enter the U.S. to get married within 90 days of entering the U.S.

Bringing Children of the Foreign Fiancé

The K-1 process also allows the U.S. citizen to bring the children of the foreign fiancé to the USA under the K-2 VISA. The child of the foreign fiancé must be unmarried and under 21 years of age.

Legally able to Marry

Ensure the U.S. citizen (petitioner) and the foreign fiancé (beneficiary) can legally marry. This means the foreign fiancé and petitioner are either single, divorced/annulled, or widowed. They need to provide evidence if either is divorced/annulled or widowed.

Meet in Person

Petitioner & foreign fiancé MUST physically meet in person and should have pictures together. The meeting should have been within 2 years of filing. Please note that this does not mean the relationship is 2 years old. There is no rule for how long the relationship should be. Some couples have only known each other for 6 months or less and are successful with the K-1 process. But there is a rule for physically meeting in person, and that must happen at least once within the last 2 years before the U.S. petitioner files the I-129F.

There are only (2) exceptions to the rule of meeting physically in person:

(1) Religion/Traditions. The requirement for the U.S. petitioner to meet the fiancé in person would violate strict and long-established customs of the fiancé’s culture or social practic and that all aspects of the traditional arrangements have been or will be met following the custom or practice.

(2) Extreme Hardships. The requirement for the U.S. petitioner to meet the fiancé in person would result in extreme hardship to the petitioner.

NOTE: These exceptions seem hard to get from what I have seen. I don’t know anyone who got through the process without meeting in person but it is possible.

Provide Financial Support

The petitioner must be capable of providing for the foreign fiancé. A poverty guideline shows how much the petitioner is expected to make to support the foreign fiancé and the children (if any) that come to the USA. During the foreign fiancé’s embassy interview, they have to prove that the U.S. petitioner makes enough money to support the foreign fiancé in the USA. The U.S. petitioner’s income must be above the poverty line. If the U.S. petitioner does not make enough income, they may have other options.

Beyond the K-1 Visa and After Marriage

After marriage, the K-1 visa holder fills out the I-485, adjustment of status:

This allows the foreign fiancé to change their status from temporary nonimmigrant to an immigrant with a 2-year conditional green card.

Becoming a green card holder allows immigrants to become U.S. citizens. Or they can keep renewing the green card.

The envelope should be a packet when the U.S. petitioner is ready to send the documents. One misconception of the I-129f, Petition for Alien Fiancé, is that it is just one form and a fee. In truth, the I-129F package is like a tree with many branches of required documents (Figure, I-129F Tree).
