    Introduction

    In May 2022, President Joe Biden reportedly hired Richard Sauber as legal counsel, possibly with the intent of defending against impeachment charges. At the time, Democrats comprised a majority of both the House of Representatives and the Senate, so Biden did not face an imminent challenge. Looking forward to the midterm elections of November 2022, though, it seemed likely that Biden would face some sort of investigation.

    Sauber provided the right sort of legal representative for Biden. He previously served as legal counsel to Biden's 2020 presidential campaign. He was rewarded with an appointment as General Counsel of the Veterans Administration. His professional background was as defense counsel for clients accused of white-collar crimes. Thus, he had both loyalty to Biden and expertise in defending against the type of wrongdoing that would likely be investigated by Republicans.

    While Biden purportedly hired Sauber to defend against congressional investigations, it seems likely that Sauber will end up advising Biden during impeachment proceedings. The hiring of Sauber indicates that the Biden administration at least believes that impeachment is a very real possibility for the president.

    As president, Biden presumably has superior information regarding threats to his administration. While many political observers believe that he is likely to be impeached, he could have even more compelling reasons to believe that that is the case. He also knows the details of his own past actions, including any actions that provide a basis for impeachment.

    Even to those who are outside of the Biden administration, though, it seems that impeachment is likely. There are three factors supporting this conclusion:

    First, the two impeachments of President Donald Trump lowered the bar for impeachable offenses. Among other things, Trump was impeached for abusing his power. If the president can be impeached by political rivals merely because those rivals believe he has abused his power, could any president ever escape impeachment again? In the first year and a half of his presidency, Biden has already provided many substantive bases for impeachment. If Trump was impeachable, then Biden is as well.

    Second, Republicans are expected to win
