Are ‘restocking’ fees legal?

Q I ordered a Dell computer from an eBay seller, paying £339.29 plus an extended warranty for £66. I used my credit card for both transactions. The computer wasn’t what I expected so I returned it under the Consumer Contract Regulations (CCRs). The seller has refunded me what I paid for the computer, but they’re withholding the £66 I paid for the warranty as a fee for “restocking” the computer. Is that legal?
