Description

In a significant development at the Indiana Statehouse in Indianapolis, the Indiana Supreme Court issued a ruling on Thursday afternoon, reinstating Richard Allen's original attorneys, Andrew Baldwin and Brad Rozzi. This decision came just hours after a hearing, notably held outside of Carroll County, where Allen is accused of the 2017 murders of Delphi teenagers Abby Williams and Libby German.

The court's decision, which was partly based on the written submissions and arguments of counsel, granted the petition to restore Baldwin and Rozzi as Allen's court-appointed counsel. However, the court unanimously denied other requests, including the removal of special judge Frances Gull and the demand for the trial to occur within 70 days.

This ruling follows a controversial dismissal of Baldwin and Rozzi in October by Judge Gull, after a leak of Delphi crime scene photos from Baldwin’s law office. Court records reveal that a former employee of Baldwin's firm, who is now facing criminal charges, admitted to taking these photos without Baldwin's permission or knowledge.

Judge Gull had cited this leak and other instances as evidence of Baldwin and Rozzi's gross negligence in defending Allen. She also accused them of making false statements, leading to her decision to replace them with new public defenders.

The reinstatement of Allen's original attorneys raises questions about the potential rescheduling of his trial. Initially set for January, the trial was postponed to October 2024 following the removal of his original defense team.

In response to the court's decision, Allen's attorneys, Mark Leeman and Cara Wieneke, expressed their satisfaction. Wieneke, after speaking with Allen's wife, shared that the family is relieved and happy about the reinstatement of the original defense counsel. The family's reaction underscores the significance of this latest turn in a case that has captured widespread attention.
