Motta speculated, “If she gets up there and for whatever reason takes the fifth, it’s creating a nasty situation. We can only infer one thing when somebody takes the fifth – that they’ve done something wrong.”

Motta voiced his belief that Murdaugh might indeed be granted a retrial, primarily due to the complexities surrounding jury tampering allegations. “If she tampered, we can prove that she tampered at all, the guy gets a new trial,” he asserted, highlighting the stringent legal standards against jury tampering.

He also didn’t shy away from criticizing Murdaugh’s previous decision to testify, advising against a repeat in the retrial. “Your testimony is what got you convicted,” Motta noted, underlining the risks involved.
