In the wake of Mark Salling’s suicide, the child pornography case against the actor has officially been dismissed.

According to court documents obtained by E! News, a United States District Judge granted the dismissal request from the U.S. Attorney’s office. However, the case was dismissed “without prejudice” per the prosecutor’s request, meaning that it can be refiled in the future.

His death comes just a few weeks prior to his four to seven year prison sentence for possession of child pornography. Salling pleaded guilty in December 2017 and agreed to serve the jail time followed by 20 years of supervised release. Additionally, he agreed to pay $50,000 in restitution fees to each victim and register as a sex offender.
