Big week in Sports Law! We broke down the Brian Flores racial discrimination class action lawsuit on our last episode. This week the Texans (4:45) hired Lovie Smith and the Dolphins hired Mike McDaniel, which brings the total of black NFL head coaches to three including Mike Tomlin. Not too long ago, and before bringing the lawsuit, Flores was a top candidate to be hired by the Texans. How does Lovie Smith's hiring impact Flores' lawsuit? Standard head coaching contracts have an arbitration (22:36) provision that Roger Goodell arbitrates any disagreements between a coach and a team. How does the arbitration clause play into the Flores and Gruden lawsuits? Dan Wallach wrote an article on this and you can read more here. Alvin Kamara (28:34) was charged with battery resulting in substantial bodily harm after an altercation that occurred in a night club in Las Vegas leaving a man with an orbital fracture on his right eye. We discuss the case and impact going forward. Trevor Bauer (37:06) will not face criminal charges from the allegation of sexual assault. What is next? Will there be a civil lawsuit? Tyler Skaggs' criminal trial (45:52) against former Los Angeles Angels' communications director Eric Kay began this week and there are a list of 7 Angels players to be called as witnesses. The defense has named Matt Harvey, former Mets pitcher, as a witness for allegedly being a drug source and giving Percocet to Skaggs. Former LA Angels Visiting Locker Room clubhouse employee Bubba Harding (55:12) sued MLB and LAA for defamation after he was fired for reporting that MLB pitchers came to him for illegal sticky substances.
