Author’s Preface
I hesitate in writing this because I am neither a proficient writer, nor very articulate. However, I feel compelled to share how I discovered how shamefully negligent and insincere our government officials have become. It starts at the top and flows all the way down to the judges and government officials at the local level.
I initially wrote this thinking it’s me against the government, the system, and all those evil agents. I’m not a hero. I am just one voice. One man. Can one man convince the American people to change the system radically? Should I have given up, once I realized my limitations even though these same government agents were way out of my league? All my life I have avoided accusing people in authority of any misconduct, as I know how difficult it is just getting through life. But based on what I experienced and suffered, I felt it was too much to overlook and had to speak out!
I started writing this as an essay on the 3 Cs
: collusion, corruption and conspiracy within the Justice System in America. Especially on institutionalized CYA, more appropriately extended to CTA (cover their asses). What I mean, is that government employees will do anything at any cost; lie, commit perjury, or whatever, to protect one another, sort of like an extended family. Our president’s bold contempt for the constitution and individual rights has hurt this country. We no longer live in a land where the citizens respect the US Constitution and Bill of Rights.
When I began writing this, I had great hope America would change. However, I became disillusioned as it became obvious the American people were apathetic and complacent. This was in addition to realizing the government is entrenched in a web of conspiracy, corruption, greed and collusion.
I imagine Al Gore went through something like this. Maybe that’s the reason he refused to run for the presidency again. I know I’d make a terrible president, as I am not articulate enough. But when good people like Al Gore refuse to run, what does that say about America and its political system? Is it hopeless? I should have known that as long as I continued to act as an idealistic crusader against evil; sooner or later it might attract the attention of someone or some government agency who yielded much more power than me, and get me into some real trouble.
Well guess what? It happened!
I always thought one had to live life to understand it. This is the reason I’ve experienced many different lifestyles from living in a favela – a slum in Rio – doing research, to the ritzy Northport on Long Island. I have experienced the Peace Corps, refugee camps, Hollywood, Tokyo, New York City, Europe, Manila, Beijing, and India and survived earthquakes and other natural disasters. God has shown me a great deal of this world.
There have been many books published exposing problems under the corrupt Republican rule (with special interest and consideration given to big business and big money), but they were all written by extremely erudite authors such as judges, politicians and journalists, just to name a few.
I decided to write this expose for the average person from a first hand perspective, and to let you know if it could happen to me, it could certainly happen to you. It is frightening when you take into consideration the recent erosion of our civil liberties along with the constant disregard for our constitution and the rule of law instead of rule by edict.
I considered several titles including:
Rites of Passage – because I believe we all must endure happiness, sadness, good times and hardships on our way to maturity.
How to Protect Yourself from the Federal Government – for reasons that will be clear after reading the book. There are so many things one is allowed to choose not to do.
The Ultimate Victim – again, due to my naïveté and ignorance of government agents’ aggression, conspiracy and collusion, including self-centered egotism and proclivity to benefit and protect their status at the expense of others.
Trials and Tribulations – this is my story in a legal sense. It applies to the various restrictions, burdens and sufferings many American’s endure under the discipline of the administration and strictures imposed by its evangelical and neoconservative allies.
Pride and Prejudice – because this is a story about the self-righteous pride that certain agents of Fatherland Security, court-appointed lawyers and psychologists, including the staff of the Bureau of Prisons punished the accused to suit their pre-existing biases.
Chaos and Confusion- a story of how the government encouraged and exploited the lack of understanding concerning differences in ethnicity and sexuality in order to fuel moral panic. The politics of fear rest upon such a foundation of planned neglect for education.
Don’t be like Me – many people feel secure because they have learned to carefully observe the arbitrary standards for being recognized as either: a) patriotic or a friend of foreigners, b) gay or straight, and c) familiar with other customs or safe and self-righteous. Then, there are people like me who have taken risks to experience the world and follow their heart, often at great expense and resulting in great frustration.
I finally settled on Betrayal of Confidence; The United States Government vs. the American People and the World.
This title most accurately describes the content and expresses hope that perhaps a different President could bring about positive change for our country, including the courts and jails. (Author's note: Interspersed in this book are various sayings, jokes, and quotes I have gathered throughout my lifetime, especially during the worst of the last few years. They have been added for color, commentary and to show that even after all that has happened, I have managed to retain my sense of humor.)
Introduction
Their dirty little secret is out! I discovered that federal, state and local governments don’t always obey their own laws. Would you consider a government that broke its own law on a regular basis a friend of yours? Ours is a criminal justice system that works to subvert and shred the constitution, what a concept.
Our freedoms guaranteed under the Constitution are under relentless and devastating attacks. I thought as an American citizen, I had certain rights, liberties and freedoms as stated in the US Constitution and especially in the Bill of Rights. While many have taken these rights for granted, I discovered the government regularly prosecutes certain Americans for speaking freely and punishes them for saying things the government doesn’t want others to hear.
The government actually commits crimes by setting traps for ignorant citizens, naïve in their beliefs, with whom it disagrees. They break the law in order to enforce the law by prosecuting people who are innocent and have even gone as far as offering bribes and making threats.
Our Constitution shows a clear primacy for the individual over government, yet our government has tortured people who’ve been arrested. There have been cases where Americans were locked up for life without charges ever being filed, foreigners who were prosecuted in secret, and whose lawyers were arrested for stepping forward to defend them, mail tampered with, and questionable information obtained and used against those same defendants. This is not the America our Founding Fathers had in mind.
Judge Andrew Napolitano once stated "the government can (and should) convict us, if it follows procedural due process." This means, we are to know in advance the violations of the law the government will prosecute, that we are fully notified of those charges, have a fair trial or hearing with counsel before a neutral judge or jury and given the opportunity to confront and challenge any evidence against us. This is provided the government can prove their allegations beyond a reasonable doubt, along with the right to appeal.
I am convinced that the former President’s inner circle outsourced the latest war effort for the benefit of his cronies in addition to his own personal financial gain. Millions died and suffered without any oversight. Certain big businesses like Halliburton, Kellogg-Brown, Root and Black-Water committed atrocities by moving their headquarters and profits to other countries such as Dubai while laying off thousands of Americans who depended on their jobs.
America had a great opportunity to be the shining example to the world after the attacks of 9/11. The entire world was with us and wanted to learn by our example. The region of China where I lived loved us. Americans were obliged to stand and bow in restaurants. Instead, the former President’s example, in my opinion set us back hundreds of years in many respects. I don’t think anyone in the world trusts us now, with the possible exception of Israel.
I believe that the former President stole both elections, partially by rendition, but assuredly by deception and election fraud. By taking advantage of his powers and voiding the Constitution except when it suited his purposes, he showed the world what his version of ‘democracy’ was really all about. People around the world began losing their civil liberties as we lost ours. Dictators and oligarchies flourished as people lost their rights, dignities and lives. What happens in this country affects other countries. We became the shining example for torture, governmental abuse, conspiracy, and corruption.
If the former president was so adamant about promoting democracy, why didn’t he send troops into Burma or Myanmar? All we had to do was remove the top ten ruthless dictators in the oligarchy. What about Darfur?
Oh, I forgot, Burma and Darfur are poor but have no oil!
St. Thomas Aquinas stated it well when he said, only just laws impose an obligation of obedience, because unjust laws are not within the power of the government to enact; and only laws that seek goodness are just.
This government will lie, cheat, and steal to enforce the laws it wants to enact while the courts continually allow it. They authorized law enforcement to break the law, including abduction and kidnapping. Law enforcement agents were granted unlimited powers to take illegal actions for no other reason than revenge. Due process was treated as a myth. The former administration considered the whole world, including Guantanamo as part of the United States when convenient, but not so much when inconvenient. The Supreme Court even upheld the government’s power to lie, deceive, misrepresent, and coerce if needed (see Frazier v. Cupp). They even sided with News Media owners, forcing reporters to lie on air.
The former President told us that spreading freedom was key to preventing future terrorist attacks, although his own policies made reform difficult to achieve. A decade ago authoritarian governments were on the defensive: today, not so much. In many countries that embraced democracy after the Cold Wars ended, free elections have not reduced the corruption, violence, or poverty that existed previously. When generals topple democratically elected governments or when autocrats like Vladimir Putin strangle them from within, they usually did so in the name of honest government and meat for dinner.
The former regime invaded our privacy every bit as much as King George III did during Revolutionary times. The Founding Fathers expressed their contempt for the invasion of privacy in the fourth amendment, by providing law enforcement must have a warrant, ‘particularly describing’ what exactly is to be searched, why, and what they are searching for.
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. Amendment IV of the US Constitution.
During the previous administration, Republican appointed courts allowed law enforcement an unprecedented amount of power to violate the US Constitution, which they did continuously, in my opinion. They placed themselves above the very laws they were sworn to uphold and the courts did nothing. Federal government officials who were trying to make a name for their selves targeted Martha Stewart and me. We both served prison terms all because government agents wanted to attack high profile targets. Both of us were convicted of obstruction of justice and conspiracy.
I soon realized everyone connected to my case including federal government agents, justice department officials, and lawyers were all lying. If this were happening, I wondered how the same government expected the average citizen to tell the truth in court? How can government officials lie with immunity and yet, we who are citizens, are expected to tell the truth or go to jail if we don’t? Do those same government officials have some type of moral authority that permits them to lie without repercussion, yet at the same time allow prosecution of regular citizens who do the same thing? Where is it written in the Constitution this type of power is granted? Why don’t our laws apply equally to all of us? Does the Constitution give the federal government that kind of power? I am convinced there must be major corruption, collusion and conspiracy in law enforcement circles and the judiciary.
To that administration we were mere commodities. They used entrapment as a tool of the policing function. Inmates were incarcerated because they represented a profit to those who held shares in the lucrative prison system. It is a business builder.
Is there not enough crime to keep the powers that be busy?
Is there someone they want incarcerated?
Law enforcement may say, Let’s stimulate crime by tossing out a lure or two. In doing so, we’ll create opportunity.
I guess there weren’t enough legitimate crimes around waiting to be solved, or else they had too much time on their hands. What happened to the principles of our society? Aren’t government agents sworn to uphold the law?
Why did we give them a free pass to commit crimes in order to prevent further crimes? Could it be because they received money based upon the number of arrests made, regardless of whether they were reasonable or not? This created an incentive for certain agents to engage in certain investigations against innocent citizens. Regarding the issue of law enforcement, what about our individual rights? Isn’t it the government’s duty to protect its citizens?
In my case, the geniuses at the Ministry who devised this scheme against me had invested so much time and money, that they had to see it through to the end. Those particular overreaching government agents were eager for promotion and notoriety and knew how to work the system to their advantage.
What did I learn as a result? For starters, once time and resources were spent in an effort to trap or accuse you of nefarious acts, they did not stop. When they realized they could no longer, ‘get you’ by accepted means, they would resort to breaking to law in order to enforce it. And, if there were no law that criminalized your conduct, one would be created. What did those government officials think of the oath they took when they swore to uphold the law?
We, as ordinary citizens cannot depend on the government’s mantra of, We’re here to protect you.
Supreme Court Justice Louis Brandeis wrote in his 1928 Olmstead v US dissent that Decency, security and liberty alike demand that government officials shall be subjected to the same rules of conduct that are commands of the citizen. In a government of laws, existence of the government will be imperiled if it fails to observe the law scrupulously.
