COUNCILS NEEED URGENT INTERVENTIONS

What is the appropriate remedy when councillors fail to fulfil their obligations to residents? This is the question that confronted Judge Igna Stretch in a case involving the Makana Local Municipality in the Eastern Cape. Appearing before the judge on September 12, the Unemployed People’s Movement (UPM) pleaded for the dissolution of the municipal council. Passing her judgment on January 14, Stretch acceded to the request and, three months later, turned down the council’s application for appeal. Led by the ANC, the council is now pleading with the Supreme Court of Appeal to hear its case.

This case puts a spotlight on why municipalities are deteriorating. Auditor-General Kimi Makwetu reported on Thursday that
