Description

Colin Albert took the stand in the ongoing investigation into John O’Keefe's death, recounting his presence at his cousin Brian Albert Jr.'s birthday party at 34 Fairview. Despite assertions from other witnesses, Albert stated he was not overly intoxicated. "No," he responded when asked if he was drunk, and added, "I didn’t see anyone from another group or older coming into the house before I left."

ADA Lally displayed a picture of Albert taken a few weeks after O’Keefe's death, providing the jury with a visual reference.

**Emotional Testimony from Alli McCabe**

Alli McCabe, daughter of Jen and Matt McCabe and Brian Albert’s niece, gave an emotional testimony. She was excused after describing the harassment her family endured. McCabe revealed that the state police never requested to image her phone, affirming she didn’t alter the timestamps on her texts with Colin Albert. "I don’t remember," she said when asked if state police asked to look at her phone.

The prosecution presented a photo of Colin Albert to the jury for the first time. McCabe’s testimony continued with questions about text exchanges with Albert regarding picking him up at 34 Fairview, leading to objections from the defense.

Ryan Nagel, who arrived at 34 Fairview to pick up his sister, testified that he did not see the SUV reverse and hit a pedestrian. "No," he answered when asked by ADA Lally. Nagel described the scene, "I observed there was a person inside the car, there was an interior light on and a woman in the driver’s seat."

**Forensic Testimony Highlights DNA Findings**

Teri Kun, a veterinary scientist at UC Davis, provided crucial forensic evidence. She confirmed the absence of K9 DNA on the swabs tested, only detecting pig DNA, which she noted could have come from food. "We did not see any K9 DNA," Kun stated, adding that the pig DNA could have been from food sources.

These testimonies and pieces of evidence are pivotal as the investigation continues to unravel the circumstances surrounding John O’Keefe's death. The court proceedings shed light on various aspects, from witness observations to forensic findings, aiming to piece together the events of that fateful night at 34 Fairview.
