Description
Notice of Appeal: The process usually begins with the convicted individual, referred to as the appellant, filing a notice of appeal with the appropriate appellate court. This notice notifies the court and the prosecution of the appellant's intention to appeal the conviction or sentence.Preparation of the Record: The trial court prepares a record of the trial proceedings, which includes transcripts of hearings, motions, and trial testimony, as well as relevant exhibits and evidence. This record forms the basis for the appeal.Briefing: Both the appellant and the appellee (usually the government or prosecution) submit written briefs to the appellate court outlining their legal arguments. The appellant's brief typically argues why the conviction or sentence should be overturned, citing legal errors or constitutional violations that occurred during the trial.Oral Arguments: In some cases, the appellate court may schedule oral arguments where attorneys for both sides present their case before a panel of judges. This allows the judges to ask questions and seek clarification on the legal issues raised in the briefs.Decision by the Appellate Court: After reviewing the briefs and oral arguments, the appellate court issues a decision either affirming the conviction and sentence, reversing the conviction and ordering a new trial, or modifying the sentence. The decision is typically accompanied by a written opinion explaining the reasoning behind the court's ruling.Further Appeals: If either party is dissatisfied with the decision of the appellate court, they may seek further review by a higher court. In the federal system, this may involve petitioning the United States Supreme Court for a writ of certiorari, asking the Court to review the case. However, the Supreme Court has discretion in deciding which cases to hear, and it grants only a small percentage of petitions.Execution of Sentence: During the appeal process, the convicted individual may remain in custody serving their sentence, unless they are released on bail pending appeal. If the conviction or sentence is ultimately overturned, the individual may be released from custody, and if a new trial is ordered, they may await trial outside of custody. It's important to note that the appeals process can be lengthy and complex, often involving significant legal arguments and procedural requirements. Additionally, the outcome of an appeal is never guaranteed, as appellate courts typically defer to the findings of fact made by the trial court and focus primarily on legal errors or issues of law.In this episode we hear from Ghislaine Maxwell's brother, Ian, who is once again crying foul when it comes to the process used to incarcerate his sister and we are taking a look at Ghislaine Maxwell's chances at her upcoming appeal hearing.to contact me:bobbycapucci@protonmail.comsource:Ghislaine Maxwell’s brother claims US justice system was ‘biased’ against Jeffrey Epstein co-conspirator | The Independent
