DAVID BRANNEN BIOGRAPHY
David Brannen is a disability claims lawyer and the founder of Resolute Legal. With headquarters in Moncton, New Brunswick, Resolute Legal is a national disability benefits law firm that serves Canadians who need to win payment of long-term disability benefits from insurance companies, or the Canada Pension Program (CPP), or both.
David was born in Brampton, Ontario. He grew up in Ontario and on Cape Sable Island, a beautiful fishing community in Southwestern Nova Scotia. He now lives in Dieppe, New Brunswick with his wife, two step children, and dog Penny.
David has a unique professional background that makes him uniquely qualified work in the area of disability claims. Before becoming a lawyer David obtained a Master of Science Degree in Occupational Therapy from Dalhousie University in Halifax, Nova Scotia. Before becoming a lawyer, David worked as a licensed occupational therapist in Nova Scotia, New Brunswick and the United States.
David graduated from the Schulich School of Law at Dalhousie University in 2004. In addition to earing his law degree, David also obtained a diploma in Health Law and Policy from the Dalhousie Health Law Institute.
David worked as a personal injury law for eight years at a large personal injury law firm before leaving to start Resolute Legal in 2013. David continues to act as co-counsel on some personal injury cases, but focuses almost exclusively on representing Canadians who need to win payment of long-term disability benefits from insurance companies or the CPP disability program.
INTRODUCTION
Anyone applying for disability insurance benefits in Canada faces an uphill battle. There is a good chance that your insurance company will either deny your claim, or stop payment of benefits, even if you are truthful and legitimately disabled. Understanding how and why insurance representatives deny legitimate disability claims is your key to success.
To have any hope of winning payment of disability benefits, you need to fully appreciate the claims adjuster’s dilemma. Insurance companies are in business to make a profit. Everyone in the company is incentivized to increase profits. Your disability claim – if approved – reduces profits. Your claims adjuster knows that if he approves your claim, internal auditors and managers will scrutinize his decision. He knows he better get it right – approving a claim that auditors feel should have been denied is career suicide at an insurance company.
Claims adjusters are under tremendous pressure to deny any claim – including legitimate claims –for which a plausible argument can be made in favour of denial. This is why your disability claim may be denied even though you are legitimately disabled.
If you are like most people, you will prepare a bare minimum claim, which includes only the forms the insurance company gives you. This type of claim is usually full of holes and loose ends that – for all practical purposes – requires the adjuster to deny your claim. By submitting a weak claim, you have made it impossible for the adjuster to approve it (if he wants to keep his job), even if he believes you are disabled and deserving of benefits.
So what does it take to get the adjuster to approve your claim? You need to go beyond the bare minimum and submit a claim that is comprehensive, persuasive, and includes overwhelming evidence in favour of approval. I call this the winning claim. When the adjuster receives such a claim he will breath a sigh of relief. This is a claim he can approve without fear of being overruled by auditors and managers. He won’t have to worry about losing his Christmas bonus. He can approve your claim with confidence and move on to denying other peoples’ claims that are no so well put together.
