Defective. That’s according to consumer campaigner Justin Gutmann, who has just been granted permission by the Competition Appeal Tribunal to sue Apple in a group lawsuit. He claims the company deceived iPhone users by “throttling” their devices (see box below right) without them knowing in order to stop their batteries failing.
